By downloading, installing, or using the Daywise application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
These Terms apply to all users of the App regardless of how you access it (iOS device, TestFlight beta, etc.).
We may update these Terms from time to time. Your continued use of the App after an update constitutes acceptance of the revised Terms.
Daywise is a weather-intelligence application that translates current and forecasted weather conditions into practical daily guidance across three dimensions:
The service relies on third-party weather data and is provided on an "as is" basis. Weather forecasting is inherently uncertain and recommendations may not always be accurate.
The "Feel" section and any biometric or well-being related content is based on general correlations between weather parameters and human physiology. It does not account for your individual health status, medical conditions, or personal circumstances.
Always consult a qualified health professional before making decisions about physical activity, medication, or your health based on any information provided by this App.
We are not liable for any harm, injury, or loss arising from reliance on information provided by Daywise.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, for your personal, non-commercial purposes.

We reserve the right to terminate your access to the App if you violate these Terms.
All content, design, graphics, code, and branding within the App — including the Daywise name, logo, and the Move/Feel/Live framework — are the intellectual property of Jaroslav Trubač and are protected by applicable copyright and trademark laws.
Weather data is provided by third-party data providers and is subject to their respective terms and licences.
You may not use our brand, logo, or content without prior written permission.
Daywise may offer free and premium subscription tiers. Free features are available without payment. Premium features, if offered, will be clearly marked in the App.
All in-app purchases are processed by Apple via the App Store. Payments, refunds, and subscription management are governed by Apple's Media Services Terms and Conditions.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. To manage or cancel your subscription, go to your Apple ID settings.
We do not store or process payment card information.
We aim to keep Daywise available and up to date, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the App at any time. We will endeavour to provide reasonable notice of significant changes.
Weather data accuracy depends on third-party providers. We are not responsible for errors in weather data supplied by those providers.
To the maximum extent permitted by applicable law, Daywise and Jaroslav Trubač shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim (or €10 if you have not made any payments).
Some jurisdictions do not allow the exclusion or limitation of certain liabilities — in such cases, the above limitations apply to the fullest extent permitted by law.
These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic, unless mandatory consumer protection laws in your country of residence provide for alternative dispute resolution mechanisms.
If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform.
